Trump lawyer appears to argue president can legally assassinate political rivals

Donald Trump attended Washington DC’s Court of Appeals on Tuesday for a hearing to weigh the presidential immunity plea that he hopes will see his January 6 election interference case dismissed.

A panel of three judges appeared sceptical of his claim that he enjoys sweeping immunity from prosecution as an ex-commander-in-chief as arguments were presented.

An attorney for Mr Trump raised eyebrows by suggesting at one point that a president should be immune from prosecution unless impeached and convicted, even if they have been accused of having ordered a rival’s murder by the US military.

Meanwhile, the Republican is reportedly planning to deliver at least part of the closing argument in his New York fraud trial on Thursday alongside his lawyers.

The 45th president is a defendant in a $250m civil case brought by the state’s attorney general Letitia James alleging years of fraud within his real estate empire.

Her lawsuit claims the former president and his co-defendants defrauded banks and other financial institutions by inflating his net worth and assets by billions of dollars on financial statements that helped him secure business loans and insurance.

Mr Trump, his children and two Trump Organization executives deny the allegations.

Jimmy Kimmel roasts Trump’s ‘ridiculous’ claim presidents can kill rivals

The late night host roasted Trump and his legal team for saying the “most ridiculous answer imaginable” to whether a president can should be immune from prosecution if they order a rival’s assassination by the US military.

On his Tuesday night show, Kimmel pointed out the absurdity of the Trump attorney’s argument and joked about what it might unwittingly mean for the Republican.

“If the president can order SEAL Team Six to kill a political rival, Trump had better lock the doors at Mar-a-Lago because ‘Bazooka Joe’ Biden has every reason to blow it to kingdom come right now.”

Ray Epps sentenced for Jan 6 role

A man whose life was upended by right-wing conspiracy theories accusing him of being a federal agent assigned to entrap Trump’s supporters has been sentenced to one year of probation for crimes connected to the January 6 attack.

Ray Epps received a sentence of 12 months of probation on 9 January after pleading guilty to a charge of disorderly or disruptive conduct for joining a mob in Washington DC and encouraging rioters to march to the US Capitol, where the former president’s loyalists stormed the halls of Congress to reject the results of the 2020 presidential election.

He was sentenced in the same building where Mr Trump was attending his own hearing to defend his claim to “immunity” from prosecution for his attempts to overturn the election, culminating in the mob fuelled by his election lies that he failed to stop.

Trump claims immunity is ‘the least I’m entitled to’

Trump has said presidential immunity is “the least” he is entitled to, in a rambling six-minute video in which he accused Joe Biden of “opening a giant Pandora’s box.”

The former president accused his political rival of being “the most corrupt president” in US history and warned him to “be careful” ahead of his appearance in an appeals court.

In a video released on social media on Monday ahead of his appearance in Washington, he once again accused Biden of “weaponising” the justice system against him and claimed that “people are angry that I [did] such a good job”.

Judges appear sceptical of Trump immunity claims in Jan 6 case

The trio of judges on the US Court of Appeals for the District of Columbia Circuit appeared to be sceptical about former president Trump’s claim that he enjoys sweeping immunity from prosecution as an ex-chief executive during arguments in their Washington DC courtroom on Tuesday.

With Trump present in the courtroom, not far from where a riotous mob of his supporters stormed the US Capitol just three years ago, all three members of the three-judge panel expressed at least some level of doubt at the arguments put forth by his attorneys, who were appealing a district court judge’s decision denying him the immunity that would prevent him from being tried on charges related to his efforts to unlawfully remain in office after losing the 2020 election to President Joe Biden.

Trump attorney says presidents can’t be prosecuted for selling pardons or ordering murders

Former president Donald Trump’s lawyer told a three-judge panel of the US Court of Appeals for the District of Columbia Circuit on Tuesday that a president would be immune from prosecution unless impeached and convicted, even if he was accused of having ordered a rival’s murder by the US military.

During arguments in a Washington DC courtroom, Trump attorney D John Sauer told Judges Michelle Childs, Florence Pan and Karen Henderson that Trump is immune from prosecution under the impeachment and double jeopardy clauses of the US Constitution, citing the Senate’s 2021 acquittal of the ex-president on charges that he incited the January 6 attack on the Capitol.

Judge Florence Pan, a 2022 appointee to the circuit court by President Joe Biden, almost immediately began a rapid-fire questioning of Sauer over his contention.

She asked him if, hypothetically, a president could order the killing of a rival by the US military or sell pardons and be immune from any legal consequences.

“I understand your position to be that a president is immune from criminal prosecution for any official act that he takes as president even if that action is taken for an unlawful or unconstitutional purpose, is that correct?” she said.

Trump to personally present part of civil fraud trial closing argument

Trump intends to personally deliver part of the defence’s closing argument at the conclusion of his civil fraud trial in New York on Thursday, according to a report by ABC News.

The Republican is a defendant alongside his two eldest sons, Don Jr and Eric, as well as two former Trump Organization executives.

They are represented by lawyers Christopher Kise, Clifford Robert and Alina Habba but Trump is reportedly keen to give part of the closing argument himself.

ABC News says their sources say the plans remain fluid.

The former president posted a slew of video messages to Truth Social on Tuesday afternoon, four of which were directly about the judge in the case, Justice Arthur Engoron.
